General Terms and Conditions
Last updated: 7 October 2026
1. Scope
These General Terms and Conditions (hereinafter "Terms") apply to the use of the platform exponde.com (hereinafter "exponde" or "Platform"). The Platform is operated by pixelquadrat GmbH (hereinafter "Operator"; provider details see Legal Notice). The Terms apply to all users of the Platform, regardless of whether they use a free or a paid offer. Paid contracts are concluded by exponde exclusively with businesses within the meaning of Section 14 BGB, i.e. natural or legal persons and partnerships with legal capacity who, when concluding the contract, act in the exercise of their commercial or independent professional activity. By concluding the contract, the customer confirms that they are acting as a business. exponde does not conclude contracts with consumers.
2. Subject of the contract
exponde is a business directory for the German-speaking region on which companies can create a verified profile. Users can create, maintain and publish company profiles and use further functions of the Platform (e.g. QR codes, digital business cards). The scope and design of the available functions depend on the chosen usage model (e.g. free or paid) and may change. With a paid contract, exponde provides the customer for the term of the contract with the booked plan and the services listed on the plans page at the time the contract is concluded.
3. Registration and user account
Using certain functions requires registration. Users must provide truthful information when registering. Access data must be kept confidential and protected from access by third parties. The user is responsible for all activities carried out using their account, insofar as they are accountable for them.
4. Notices by email
exponde informs the user by email about its own contracts and services that suit their use, for example when they reach a limit of their contract. The user can object to this use of their email address at any time via the link in each of these emails, without incurring any costs other than the transmission costs at the basic rates.
5. Obligations of the user
The user undertakes to use the Platform solely for its intended purpose — presenting and maintaining verified company information and using the associated functions. In particular, the user undertakes
- not to upload, publish or distribute any content that violates applicable law, in particular no pornographic, violence-glorifying, discriminatory or otherwise unsuitable content for minors,
- not to post any content for which the user does not hold the necessary rights (copyright, trademark or personality rights of third parties),
- not to attack or disrupt the Platform, its infrastructure or the systems of other users, or to circumvent their security — this includes in particular the use of malware, automated access (e.g. scraping, bots) outside officially provided interfaces, and attempts to gain unauthorised access to accounts, data or systems,
- not to provide false or misleading company information that runs counter to the verification purpose of the Platform,
- not to use the Platform to send unsolicited advertising (spam) or for other abusive purposes.
In the event of violations of these obligations, the Operator is entitled to remove content, block accounts or withdraw from the contract, without prejudice to further claims.
6. Availability
The Operator strives to run the Platform with high availability. There is no entitlement to permanent availability; maintenance work, technical faults or events beyond the Operator's control may lead to temporary restrictions.
7. Liability
The Operator is liable without limitation for intent and gross negligence and in accordance with the Product Liability Act. For slight negligence, the Operator is liable only for breach of an essential contractual obligation (cardinal obligation) whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely; in this case liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Liability for damage arising from injury to life, body or health remains unaffected.
8. User content
The respective user is responsible for content posted by users (e.g. company descriptions, images). The Operator assumes no liability for the accuracy, completeness or timeliness of user content, but checks it at its own discretion as part of the verification process.
9. Term and cancellation
(1) Users can delete a free account at any time in the account settings.
(2) For paid contracts: The minimum term is twelve months. This also applies to monthly payment. After the minimum term, the contract renews for the agreed contract term.
(3) The customer can cancel with four weeks' notice to the end of the minimum term and thereafter to the end of any calendar month.
(4) Cancellation is possible in the customer area of the portal or in writing by email.
(5) The booked plan ends when the contract ends.
(6) The Operator may terminate usage relationships without notice in the event of violations of these Terms or for good cause, and otherwise with reasonable notice. The right to terminate for good cause remains unaffected.
10. Remuneration and payment
The customer pays, at their choice, monthly or for twelve months in advance. A discount is granted for advance payment of the annual price. The remuneration for the chosen period is due at the beginning of the month.
11. Changes to the Terms
The Operator reserves the right to amend these Terms with effect for the future insofar as this is necessary to adapt to changed legal or technical conditions or to develop the Platform further. Registered users will be informed of material changes in a suitable form. If the user does not object within a reasonable period, the amended Terms are deemed accepted; this will be pointed out separately in the notice of change.
12. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
